By submitting this application you are accepting the following terms:
Early termination fee of $79 applies to one year plans.
Customer understands and agrees not to send Spam (Unsolicited email, UCE) from any system attached to Imbris circuits. Please see Spam policy on the home page of Imbris at www.imbris.com for a detailed policy. Customer agrees that if UCE is sent from any system attached to Imbris and Imbris is required to contact customer or under certain conditions disconnect customer, customer will pay the then current rate as a fee that does not apply to this contract amount or term. Example: first time offense, $250, and 250 to restart temporary service interruption. Depending on the severity permanent disconnection, which shall not relieve the customer for this contract obligation. Second offense is 5,000 and complete removal from the system.
Customer further agrees that DSL circuits are not to be used as the following:

The customer will not setup any search engine on this circuit
The customer will not make a gaming server or allow said machine to become one.
The customer will not setup an FTP server, legal or otherwise.
The customer will not place any copyrighted material on the machine if customer does not hold rights or permission from the author to use said material. If customer is notified of any violation of copyright infringement agrees to remove or show proof of right of use.

Customer further agrees not setup any video, audio streaming technology. Any violate of any provision is subject to a $1,000 fee to Imbris as non-liquidated damages and possible loss of the use of the DSL circuit.
DSL circuits are not monitored and therefore will be deemed non-critical to operation of customers business or residence.
