Acceptable Net Use Policy

Goals

IMBRIS' goals are to protect network resources, preserve the privacy and security of IMBRIS and our customers' networks, and maximize the utility of IMBRIS and the Internet, while recognizing IMBRIS' position in the Internet community as a whole.

Interpretation

The provisions of this Policy are intended as guidelines and are not meant to be exhaustive.

Generally, conduct that violates law, regulation, or the accepted norms of the Internet community, whether or not expressly mentioned in this Policy, is prohibited. IMBRIS reserves the right at all times to prohibit activities that damage its commercial reputation and goodwill.

This "Acceptable Use Policy" has been posted to advise our customers of what is acceptable use of our system and service.

Our company believes strongly in your Freedom of Speech and the 1st Amendment rights. We do not believe in censorship, therefore you have the full range of everything that we can provide in terms of Internet services and activities.
Most things you can do on the Internet are perfectly okay...in fact, we encourage you to explore and try new things.
Some activities, however, can cause serious problems, and therefore are not allowed. The following list should provide you with a fair general guideline of what you should avoid.

Dial-Up Connections

Each dial-up account is authorized for only one connection at any one time. Attempting to make simultaneous connections is not allowed and will result in your account being charged an additional full monthly rate.

All accounts offer "Unlimited" hours as long as you are actively pursuing the Internet. (This means that you are sitting in front of your computer & actively using your Internet connection.) Leaving your computer connected to our modems in order to run programs that run online while the you are away from your computer is not allowed. IMBRIS reserves the right to set limits for 15 minutes idle time disconnection.

  • Users will be disconnected after 15 minutes of non activity.
  • Users must have at least one 60 minute logoff period after each 8 hours of continuous use. Any accounts in violation of the 60 minute logoff condition will be considered a 24 hour connection and will be subject to the applicable charges of a 24 hr. dedicated modem connection.
  • Dial-up accounts are given 5 MB of server space and bandwidth usage not to exceed 600 MB per month.

    Security

    Any "denial of service" attack, any attempt to breach authentication or security measures, or any unauthorized attempt to gain access to any other account, host or network is prohibited, and will result in immediate service termination, which may be without notice.

    Harassment of any sort is expressly prohibited. This includes direct and indirect harassment through any of the following methods, non-exclusively: talk, write, e-mail, irc, MUDs, Usenet News, and all other methods of communication through the Network.

    Any and all illegal activities such as piracy, cracking, extortion, blackmail, and unauthorized access to any computers or processes on the network are forbidden.

    Cooperation with Other Providers

    Using IMBRIS' facilities to engage in activities that violate the Terms of Service of any other network access provider is prohibited. For example, sending unsolicited commercial e-mail through IMBRIS' facilities to the subscribers of any Internet or online service provider that disallows unsolicited commercial e-mail is prohibited.


    E-mail and Usenet News

    Using any IMBRIS account or server to send duplicative, unsolicited e-mail messages (commercial or otherwise), or to collect the responses from unsolicited e-mail, is prohibited.

    Similarly, using any IMBRIS account or server to post advertisements or messages that violate the charter of any newsgroup or mailing list is prohibited.

    IMBRIS reserves the right to make the determination whether a given message violates the newsgroup or mailing list charter. In most cases IMBRIS will defer to the judgment of the newsgroup or mailing list moderator or administrator.     Commercial messages that are appropriate under the charter of a newsgroup or mailing list, or that are expressly solicited by the recipients, are permitted.

    Conduct in connection with e-mail or Usenet news that is an obvious nuisance (such as "mail bombing") or that would be unlawful in other contexts (for example, threats, harassment, defamation, obscenity, or software piracy) is prohibited.

    It is forbidden to use the password file or any other source or list of users on our system for purposes of E-Mail bombing. This includes any sort of mass-mailing for ANY purposes, whether intended for good or ill.

    In particular, without limiting the generality of the foregoing, you shall not do, nor permit any of the your authorized users or other third parties to do, any of the following:

    • Disclose private communications or disclose confidential information without permission to parties other than the intended recipient;
    • Restrict or inhibit any other user from using and enjoying the Internet;
    • Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, or profane information of any kind, including without limitation any transmissions encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, provincial, state, national or international law,
    • Impersonate another person when posting or transmitting messages;
    • Choose a user name for your email address which is protected by copyright, or other intellectual property right, without obtaining permission of the copyright or other right holder;
    • Choose a user name for your email address which is libelous, defamatory, obscene, threatening, abusive or hateful;
    • Post or transmit any information or software that you are aware contains a virus, worm, or other harmful component;
    • Upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the Internet which is protected by copyright or other proprietary right, without obtaining the permission of the copyright owner or right holder;
    • Falsify user information provided to us or to other users of the Service in connection with the use of our Service;
    • Multiple logins, including, without limitation, logging in simultaneously from home and office, unless expressly provisioned through specific Internet access service packages;
    • Engage in account sharing, including, without limitation, permitting third parties to use your Internet access account and password;
    • Engage in line camping, including, without limitation, being connected for excessive periods of time;
    • Unauthorized attempts to use or gain access to any account or computer resource not belonging to you;
    • Use any means or device to obtain, or attempt to obtain, the Services with the intent to avoid the applicable charges;
    • Use any means or device to gain unauthorized access to, alter, or destroy (or any attempt thereof) the data or information of any other customers and/or their end users;
    • Engage in any activities that will cause a disruption of the Services (e.g. synchronized number sequence attacks) to other users and/or their end-users;
    • Engage in any activities that will damage the systems of, or cause a disruption of Internet services to, third parties;
    • Spamming or other advertising that is objectionable to us in our sole discretion, including, without limitation, sending unsolicited mass e-mailings to more than twenty-five (25) e-mail users, if such unsolicited e-mailings provoke complaints from the recipients or posting a single article or advertisement to more than ten (10) Usenet or other news groups or forums;
    • Posting to any Usenet or other news group, forum, e-mail mailing list or other similar group or list articles which are off-topic according to the Charter or other published FAQ, or description of the group or list;
    • Use the Services in any manner so as to harrass, threaten, abuse, embarrass, or cause distress, unwanted attention, or discomfort to any person or entity;
    • Use the Services to post or transmit any chain letter, or letters or messages that offer a product or service based on the structure of a chain letter;
    • Engaging in any of the foregoing activities using the service of another access provider, but channeling such activities through a Company account or re-mailer, or using a Company account as a mail drop for responses; and
    • Use the Services in violation of the law, or in aid of any unlawful act, or to interfere with the use and operation of our network.

    Auxiliary Programs

    Using programs that interfere with others' use, or running an IRC robot, on any IRC server is prohibited. When logged into any IRC server, users are expected to comply with the rules and policies established by the server's administrator.

    It is forbidden to operate a mush, mud, or any other automated agent without prior written consent. This INCLUDES running any sort of IRC Bot or automated program while you are not logged in or "actively pursuing the internet".

    SLIP and PPP emulators are not allowed here, as they use excessive system resources. We provide SLIP/PPP access through the terminal server thereby keeping our Unix machine out of the SLIP/PPP loop.


    Forgery of Identity

    Falsifying addressing information or otherwise modifying headers to conceal the sender's or recipient's identity, for the purpose of circumventing this Policy, is prohibited. This provision is not intended to disallow the use of aliases or anonymous remailers for any legitimate purpose.

    Copyright, Privacy, and Intellectual Property

    Using a IMBRIS connection to commit, aid or abet any violation of copyright or intellectual property law is prohibited.

    This prohibition includes publishing a private e-mail message to third parties, by any means, without the express prior consent of the author.

    The e-mail addresses of IMBRIS subscribers are not for sale or commercial distribution to third parties without the express prior consent of the subscriber.

    Consequences of Violation

    Violation of this Policy by a IMBRIS customer may result in temporary suspension or permanent termination of service, at IMBRIS sole discretion.

    IMBRIS does not issue service credits for any outages incurred through service disablement resulting from Policy violations.

    Any of the previous activities are grounds for account termination without possibility of refund. All logs of illegal or suspected illegal activities are retained and we reserve the right to turn over any and all such logs to the applicable law enforcement agency.
    We reserve the right to remove any and all files and programs which are illegal or intended for illegal purposes from our system. We also reserve the right to terminate any running process that adversely affects the operation of our system. We reserve the right to refuse service.

    Modification

    IMBRIS reserves the right to add, delete, or modify any provision of this Policy at any time without notice.

    If you are not intending to abuse our system or do any of the above, please forgive this unfortunately necessary policy. The Internet is for us all, and this is just some protection for your benefit as well as our own
    Amendment Article I of the Bill of Rights
